Himalaya Yoga Valley (Europe Limited) Virtual Studio for Classes and Workshops

1. Live virtual studio and classroom

1.1 Clients agree to create a safe yoga practice environment for their virtual or recorded classes and workshops. They agree that there will be a minimum of 4 feet of free space around the yoga mat. They agree to remove any nearby furniture or objects and be away from sharp corners. They agree to practice on a level and non slippery surface, always using a yoga mat. They agree to follow all safety instructions from Himalaya Yoga Valley (Europe Ltd) teachers.

1.2 The Client who has purchased the Pass or Membership is the only person entitled to view the recorded or live classes and access course material. Sharing of login details are not permitted. Anyone else accessing the classes are liable for full payment of fee.

1.3 Clients are strictly prohibited from any recording or image capture of classes, either live or recorded, from Himalaya Yoga Valley Online, or any other Himalaya Yoga Valley (Europe Limited) Websites, unless explicit written permission has been granted.

1.4 Clients are prohibited from taking photos, or other digital copies, of the online class and workshop screens or engage in any photography or filming of other clients or teachers.

1.5 Himalaya Yoga Valley has the right to change or cancel an online virtual class, including the description of the class and the scheduled teacher as a result of changes beyond Himalaya Yoga Valley (Europe Limited)s control.

1.6 Himalaya Yoga Valley (Europe Limited) has the right to change the online platform to another of their choice.

1.7 Himalaya Yoga Valley (Europe Limited), reserves the right to refuse a client access to online programs classes or workshops.

1.8 Clients must be 18 years or over to attend virtual classes and workshops at Himalaya Yoga Valley unless otherwise specified.

1.9 Should Himalaya Yoga Valley (Europe Ltd). have to cancel an online class which has been purchased with a Single Pass, a full refund will be offered.

1.10 In the unlikely event that a Himalaya Yoga Valley Centre (Europe Limited) online workshop or private class is cancelled, 100% of the payment will be refunded, or an alternative workshop or private class will be offered.

1.11 If daily online classes, workshops or private classes must be abandoned or interrupted due to exceptional circumstances outside the control of the Centre there will not be a refund if more than half of the event has been completed (start and finish times inclusive).

1.12 Himalaya Yoga Valley Europe Limited accepts no responsibility for cancellations, delays, changes or losses caused by acts of God, war, and threat of war, closure of airports, pandemics, epidemics, interrupted train or bus services, civil strife, natural disasters, accidents or any other events beyond their control.

1.13 Himalaya Yoga Valley Europe Limited accepts no responsibility for injuries, illnesses, medical or psychiatric conditions of registered clients developed during, or subsequent to,online classes or workshops.

2. Payments

2.1 All single class passes and memberships purchased are non-refundable and non-transferrable and must be used by the person specified at time of purchase.

2.2 When purchasing a single class pass or a Membership, you agree to use all classes sold by the expiration date.

2.3 Himalaya Yoga Valley (Europe Limited) cannot guarantee virtual access to an online workshop until full subscription or workshop fee has been received.

2.4 Himalaya Yoga Valley (Europe Limited) has full discretion to offer discounts and concessions to individuals as it sees fit. This does not automatically entitle other client to the same discounts and concessions.

2.5 Only one (1 discount offer can be used per purchase. All payments are electronic via payment portal of Stripe . All Credit Cards will be processed in Euros at the time of payment. Himalaya Yoga Valley (Europe Limited )is not responsible for any fees, charges, exchange rates or additional charges levied by individual financial institutions or Credit Card companies.

3. Refund Policy for Class Passes and Memberships

3.1 Monthly Membership is not refundable or transferable between persons.

Single Pass for online classes are not refundable .

3.2 Medical Cancellations – Refunds or part refunds for online Monthly Membership fee, single class purchases, private classes or online workshop fees can be considered on medical grounds and are assessed at the Discretion of the Manager, Himalaya Yoga Valley (Europe Limited) whose decision is final. To consider the refund, medical certificate will be emailed to info@yogacorkireland.com.

4. Security of Information

4.1 Himalaya Yoga Valley (Europe Limited) takes the privacy and security of our clients and their personal information very seriously. Information collected is used strictly by us to provide our services to you and is required for the provision of our services.

4.2 Information submitted to Himalaya Yoga Valley (Europe Limited) may be shared with administrative staff and teachers solely for the purpose of administration and teaching.

4.3 Customers understand that Himalaya Yoga Valley( Europe Limited) engages in social media networking, such as Facebook, Instagram etc. as part of the company’s promotional endeavours, which may involve sharing of photos or other information. You will be asked for consent in advance for realtime studio photo shoots or sharing of personal information.

4.4 Himalaya Yoga Valley (Europe Limited) will not sell clients personal information to others.

4.5 Himalaya Yoga Valley (Europe Limited) will not share health information that may have been provided in regards to participating, withdrawing or refund requests from a program, yoga class, or workshop

4.5 Himalaya Yoga Valley (Europe Limited) may contact customers about upcoming events and opportunities. This will require the use of contact details. If you do not wish to be contacted, please opt out or make this explicitly known to us via email to info@yogacorkireland.com.

4.6 Links from or to web sites outside our Company websites www.yogacorkireland.com or www.yogagoaindia.com are meant for convenience only. Himalaya Yoga Valley (Europe Limited), includes our India company location, does not review, endorse, approve or control, and is not responsible for any sites linked from or to the above websites, the content of those sites, the third parties named therein, or their products and services. 5. Injuries and Medical Conditions

5.1 Clients agree that they undertake any online classes or workshops at their own risk. Himalaya Yoga Valley (Europe Limited) holds no liability for physical injuries or psychological/mental ill health that occur to clients or trainees during online workshops, trainings or classes

5.2 Clients are fully responsible for following the instruction of Himalaya Yoga Valley (Europe Limited) teachers for injury prevention, including modifications for asana and use of props.

5.3 Clients with pre-existing and existing physical injuries and medical conditions should seek medical advice before purchasing a Membership for online classes and workshops.

5.4 Clients agree to monitor their own bodies and be responsible for their self care during online classes and workshops.

5.5 Clients with pre-existing and current injuries and medical conditions have contacted their treating physician or allied professional (physiotherapist, counsellor etc.) for clearance to participate in online classes and workshops.

5.6 If you are pregnant, you are strongly advised to only take Pregnancy Yoga, Gentle Glow and Restore and Revive classes for health and safety reasons of the baby and Mother. Yoga during pregnancy is contraindicated for first trimester. The highest risk for miscarriage occurs in the first trimester, as this is the time of embryo implantation and attachment of the placenta to the uterus. Yoga can be practiced after the first trimester but it must be modified.  Clients who suspect they may be pregnant are strongly advised to seek medical advice before purchasing a Membership. Our priority is always the safety and wellbeing of our clients

5.7 By partaking in online workshops and classes, you as the client retains control and direction over all your physical activities and voluntarily assume full liability and accept the risk of harm, including physical injury and discomfort as a result of participation in activities during the classes or workshops.

6. Photo / Video Release

6.1 From time to time Himalaya Yoga Valley (Europe Limited) uses digital images and videos of online workshops and classes for use in a promotional capacity on Facebook, Instagram and the company website etc. Clients will be informed and you will be asked in advance for consent if you wish to participate in the workshop or class.

6.2 Screenshots, photos and videos taken by clients during online workshops and classes are strictly prohibited. Himalaya Yoga Valley Centre (Europe Limited) retains no liability for use of pictures or videos taken by other paying participants in the workshops or classes.

Use of Materials

7.1 Unless otherwise stated, Himalaya Yoga Valley owns the intellectual property rights for all material used for all online workshop, trainings and classes.

7.2 All intellectual property rights are reserved.

7.3 You may view and/or print pages from www.yogagoaindia.com, www.yogacorkireland.com and himalayayogavalley.online for your own personal use subject to restrictions set in these Terms and Conditions.

8. Schedule and Programme Changes

8.1 Himalaya Yoga Valley Europe Limited reserves the right to alter the advertised schedule of classes and programmes and reserve the right to select yoga teachers from a pool of qualified teachers depending upon availability and location.

9. Changes to our policy

9.1 If you have not read, understood or do not agree to these Terms and Conditions do not proceed to purchasing a Membership, booking a class or workshop or any other programme or event by Himalaya Yoga Valley online. By purchasing a Membership, booking an online class or workshop or any other event you are stating that you fully and voluntarily agree to said Terms and Conditions and acknowledge that you have both read and fully comprehend the nature and consequences of agreement to these Terms and Conditions.

9.2 It may be necessary for us to review and revise these Terms and Conditions. Himalaya Yoga Valley (Europe Limited) reserves the right to review and change these terms and conditions at any time. Himalaya Yoga Valley In Person Studio Classes & Workshops Terms & Conditions

1. Class Bookings & Attendance

1.1 Himalaya Yoga Valley Europe Limited, reserves the right to refuse admission to classes or workshops.

1.2 Students must be 18 years or over to attend general classes and workshops at Himalaya Yoga Valley unless otherwise specified.

1.3 Teenagers 16 years may attend our classes with Guardian

1.4 Classes are booked on a first-come first-served basis.

1.5 Students must arrive and check in no later than 5 minutes before class start time. Places may be given to wait-listed students after this time.

1.6 If you are more than 15 minutes late for your class, for safety reason it is not possible to join the class

1.7 Should Himalaya Yoga Valley (Europe Limited) have to cancel a class full refund will be offered for Single Class Pass. For Memberships or multiple Class Passes, the cancelled class will be restored to the account.

1.8 In the unlikely event that a Himalaya Yoga Valley Centre (Europe Limited) workshop or private class is cancelled, 100% of the payment will be refunded, or an alternative workshop or private class will be offered.

1.9 If daily classes, workshops or private classes are halted or interrupted due to exceptional circumstances outside the control of Himalaya Yoga Valley Centre ( Europe Limited) Centre there will not be a refund if more than half of the event has been completed (start and finish times/ dates inclusive).

1.10 Himalaya Yoga Valley Centre ( Europe Limited) accepts no responsibility for cancellations, delays, changes or losses caused by acts of God, war, and threat of war, closure of airports, storms or flooding, interrupted train or bus services, civil strife, pandemics, epidemics, natural disasters, accidents or any other events beyond their control.

1.11 Himalaya Yoga Valley (Europe Limited) accepts no responsibility for injuries, illnesses, medical or psychiatric conditions of customers developed during or subsequent to classes or workshops.

1.12 Himalaya Yoga Valley (Europe Limited) accepts no responsibility for loss of, or damage to, personal property during their attendance at the Centre.

2. Payments

2.1 All Class Passes and Memberships purchased are non-refundable and non-transferrable and must be used by the person specified at time of purchase.

2.2 When purchasing a Class Pass, you agree to use all classes by the expiration date.

2.3 A Class Pass expiry cannot be extended beyond its expiry date.

2.4 Himalaya Yoga Valley (Europe Limited) cannot guarantee a place in a class or a workshop until the full payment has been received.

2.5 Himalaya Yoga Valley (Europe Limited) has full discretion to offer discounts and concessions to individuals as it sees fit. This does not automatically entitle other customers to the same discounts and concessions.

3. Cancellation Policy

3.1 Class Cancellation – Without exception, pre-booked classes or workshops must be attended. Cancellation of a booked yoga class or workshop will be accepted up to 6 hours before the class to avoid forfeiting the class or workshop value. There are no exceptions or discretion for this policy.

3.2 Reformer Pilates Cancellation – Must be made at least 12 hours before the class start time for the credit to be automatically returned. Cancellations made within 12 hours of the class are not eligible for a refund or credit return. This policy ensures fair access and allows other members the opportunity to book available spots.

3.3 Membership Cancellation – Become unlimited – enjoy our best-value and most popular membership! Important: This membership renews monthly and continues to roll over each month unless you choose to cancel it with us.

4. Refund Policy

4.1 Class Passes and Memberships cannot be refunded or returned, exchanged or transferred between persons.

4.2 Medical Cancellations – Refunds or part refunds for membership fees, private classes or workshop fee may be considered for medical reasons and with a medical certificate. Refund request are assessed on an individual basis, without precedent, at the discretion of the Manager, Himalaya Yoga Valley Europe Limited whose decision is final.

4.3 When booking classes, workshops, events or training courses, it is your responsibility to check dates for suitability. Himalaya Yoga Valley ( Europe Ltd) are not responsible for errors or miscalculations in your booking dates.

4.4 Workshop fees including deposits are non-refundable. If the workshop booking is cancelled within 48 hours of the schedule time, the fee can be used as full or part payment for a future workshop.

4.5 Gift Certificates may be used for at all virtual and non virtual services. Gift Certificates are not eligible for exchange for cash value.

Himalaya Yoga Valley (Europe Limited) Online Yoga

Before you proceed to purchasing a Membership or class pass, booking a class or workshop or any other programme or event by Himalaya Yoga Valley online please read our Terms and Conditions below.

1. Live virtual studio and classroom

1.1 Clients agree to create a safe yoga practice environment for their virtual or recorded classes and workshops. They agree that there will be a minimum of 4 feet of free space around the yoga mat. They agree to remove any nearby furniture or objects and be away from sharp corners. They agree to practice on a level and non slippery surface, always using a yoga mat. They agree to follow all safety instructions from Himalaya Yoga Valley (Europe Ltd) teachers.

1.2 The Client who has purchased the Pass or Membership is the only person entitled to view the recorded or live classes and access course material. Sharing of login details are not permitted. Anyone else accessing the classes are liable for full payment of fee.

1.3 Clients are strictly prohibited from any recording or image capture of classes, either live or recorded, from Himalaya Yoga Valley Online, or any other Himalaya Yoga Valley (Europe Limited) Websites, unless explicit written permission has been granted.

1.4 Clients are prohibited from taking photos, or other digital copies, of the online class and workshop screens or engage in any photography or filming of other clients or teachers.

1.5 Himalaya Yoga Valley has the right to change or cancel an online virtual class, including the description of the class and the scheduled teacher as a result of changes beyond Himalaya Yoga Valley (Europe Limited)s control.

1.6 Himalaya Yoga Valley (Europe Limited) has the right to change the online platform to another of their choice.

1.7 Himalaya Yoga Valley (Europe Limited), reserves the right to refuse a client access to online programs classes or workshops.

1.8 Clients must be 18 years or over to attend virtual classes and workshops at Himalaya Yoga Valley unless otherwise specified.

1.9 Should Himalaya Yoga Valley (Europe Ltd). have to cancel an online class which has been purchased with a Single Pass, a full refund will be offered.

1.10 In the unlikely event that a Himalaya Yoga Valley Centre (Europe Limited) online workshop or private class is cancelled, 100% of the payment will be refunded, or an alternative workshop or private class will be offered.

1.11 If daily online classes, workshops or private classes must be abandoned or interrupted due to exceptional circumstances outside the control of the Centre there will not be a refund if more than half of the event has been completed (start and finish times inclusive).

1.12 Himalaya Yoga Valley Europe Limited accepts no responsibility for cancellations, delays, changes or losses caused by acts of God, war, and threat of war, closure of airports, pandemics, epidemics, interrupted train or bus services, civil strife, natural disasters, accidents or any other events beyond their control.

1.13 Himalaya Yoga Valley Europe Limited accepts no responsibility for injuries, illnesses, medical or psychiatric conditions of registered clients developed during, or subsequent to,online classes or workshops.

2. Payments

2.1 All single class passes and memberships purchased are non-refundable and non-transferrable and must be used by the person specified at time of purchase.

2.2 When purchasing a single class pass or a Membership, you agree to use all classes sold by the expiration date.

2.3 Himalaya Yoga Valley (Europe Limited) cannot guarantee virtual access to an online workshop until full subscription or workshop fee has been received.

2.4 Himalaya Yoga Valley (Europe Limited) has full discretion to offer discounts and concessions to individuals as it sees fit. This does not automatically entitle other client to the same discounts and concessions.

2.5 Only one discount offer can be used per purchase. All payments are electronic via payment portal of Stripe. All Credit Cards will be processed in Euros at the time of payment. Himalaya Yoga Valley (Europe Limited )is not responsible for any fees, charges, exchange rates or additional charges levied by individual financial institutions or Credit Card companies.

2.6 Monthly Unlimited Online Yoga Membership: Upon registration, you will receive a 10-day free trial period. Following the trial, your card will be charged €29.99 for the first month of membership. Subsequently, a monthly fee of €29.99 will be automatically deducted from your card for each successive month, on a rolling basis, until cancelled by you. Alternatively, you have the option to purchase an Annual Membership for €239, saving €120 compared to the monthly rate. Please note that this is a non-refundable product.

2.7 To cancel an online membership you need to email your request to info@yogacorkireland.com. You are required to give a minimum of 4 days notice before your next payment is due.

3. Refund Policy for Class Passes and Memberships

3.1 Monthly Membership is not refundable or transferable between persons.

Single Pass for online classes are not refundable .

3.2 Medical Cancellations – Refunds or part refunds for online Monthly Membership fee, single class purchases, private classes or online workshop fees can be considered on medical grounds and are assessed at the Discretion of the Manager, Himalaya Yoga Valley (Europe Limited) whose decision is final. To consider the refund, medical certificate will be emailed to info@yogacorkireland.com.

4. Security of Information

4.1 Himalaya Yoga Valley (Europe Limited) takes the privacy and security of our clients and their personal information very seriously. Information collected is used strictly by us to provide our services to you and is required for the provision of our services.

4.2 Information submitted to Himalaya Yoga Valley (Europe Limited) may be shared with administrative staff and teachers solely for the purpose of administration and teaching.

4.3 Customers understand that Himalaya Yoga Valley( Europe Limited) engages in social media networking, such as Facebook, Instagram etc. as part of the company’s promotional endeavours, which may involve sharing of photos or other information. You will be asked for consent in advance for realtime studio photo shoots or sharing of personal information.

4.4 Himalaya Yoga Valley (Europe Limited) will not sell clients personal information to others.

4.5 Himalaya Yoga Valley (Europe Limited) will not share health information that may have been provided in regards to participating, withdrawing or refund requests from a program, yoga class, or workshop

4.5 Himalaya Yoga Valley (Europe Limited) may contact customers about upcoming events and opportunities. This will require the use of contact details. If you do not wish to be contacted, please opt out or make this explicitly known to us via email to info@yogacorkireland.com.

4.6 Links from or to web sites outside our Company websites www.yogacorkireland.com, www.himalayayogaonline.com, www.yogagoaindia.com or himalayayogavalley.online are meant for convenience only. Himalaya Yoga Valley (Europe Limited), includes our India company location, does not review, endorse, approve or control, and is not responsible for any sites linked from or to the above websites, the content of those sites, the third parties named therein, or their products and services. Linking to any other site is at your sole risk and Himalaya Yoga Valley (Europe Limited), includes our India company location, will not be responsible or liable for any damages in connection with linking.

5. Injuries and Medical Conditions

5.1 Clients agree that they undertake any online classes or workshops at their own risk. Himalaya Yoga Valley (Europe Limited) holds no liability for physical injuries or psychological/mental ill health that occur to clients or trainees during online workshops, trainings or classes

5.2 Clients are fully responsible for following the instruction of Himalaya Yoga Valley (Europe Limited) teachers for injury prevention, including modifications for asana and use of props.

5.3 Clients with pre-existing and existing physical injuries and medical conditions should seek medical advice before purchasing a Membership for online classes and workshops.

5.4 Clients agree to monitor their own bodies and be responsible for their self care during online classes and workshops.

5.5 Clients with pre-existing and current injuries and medical conditions have contacted their treating physician or allied professional (physiotherapist, counsellor etc.) for clearance to participate in online classes and workshops.

5.6 If you are pregnant, you are strongly advised to only take Pregnancy Yoga, Gentle Glow and Restore and Revive classes for health and safety reasons of the baby and Mother. Yoga during pregnancy is contraindicated for first trimester. The highest risk for miscarriage occurs in the first trimester, as this is the time of embryo implantation and attachment of the placenta to the uterus. Yoga can be practiced after the first trimester but it must be modified.  Clients who suspect they may be pregnant are strongly advised to seek medical advice before purchasing a Membership. Our priority is always the safety and wellbeing of our clients

5.7 By partaking in online workshops and classes, you as the client retains control and direction over all your physical activities and voluntarily assume full liability and accept the risk of harm, including physical injury and discomfort as a result of participation in activities during the classes or workshops.

6. Photo / Video Release

6.1 From time to time Himalaya Yoga Valley (Europe Limited) uses digital images and videos of online workshops and classes for use in a promotional capacity on Facebook, Instagram and the company website etc. Clients will be informed and you will be asked in advance for consent if you wish to participate in the workshop or class.

6.2 Screenshots, photos and videos taken by clients during online workshops and classes are strictly prohibited. Himalaya Yoga Valley Centre (Europe Limited) retains no liability for use of pictures or videos taken by other paying participants in the workshops or classes.

Use of Materials

7.1 Unless otherwise stated, Himalaya Yoga Valley owns the intellectual property rights for all material used for all online workshop, trainings and classes.

7.2 All intellectual property rights are reserved.

7.3 You may view and/or print pages from www.yogagoaindia.com, www.yogacorkireland.com, www.himalayayogaonline.com and himalayayogavalley.online for your own personal use subject to restrictions set in these Terms and Conditions.

8. Schedule and Programme Changes

8.1 Himalaya Yoga Valley Europe Limited reserves the right to alter the advertised schedule of classes and programmes and reserve the right to select yoga teachers from a pool of qualified teachers depending upon availability and location.

9. Changes to our policy

9.1 If you have not read, understood or do not agree to these Terms and Conditions do not proceed to purchasing a Membership, booking a class or workshop or any other programme or event by Himalaya Yoga Valley online. By purchasing a Membership, booking an online class or workshop or any other event you are stating that you fully and voluntarily agree to said Terms and Conditions and acknowledge that you have both read and fully comprehend the nature and consequences of agreement to these Terms and Conditions.

9.2 It may be necessary for us to review and revise these Terms and Conditions. Himalaya Yoga Valley (Europe Limited) reserves the right to review and change these terms and conditions at any time.
